WaterPenguin: Water Reminder

These Terms of Service (“Terms”) are a legal agreement between you and Codexia Technologies, a company registered in Pakistan with its registered office at Office # 17, Fourth Floor, Ashrafi Tower, Commercial Zone 19, Liberty Market, Gulberg III, Lahore, Pakistan (“Codexia”, “we”, “us”, or “our”).
They govern your use of the WaterPenguin: Water Reminder mobile application and any related services (together, “WaterPenguin” or “the app”).
By downloading, installing, or using WaterPenguin, you agree to these Terms. If you do not agree, do not use the app.
Please also read our Privacy Policy, which explains how we handle your data and forms part of this agreement.
WaterPenguin is a general wellness and habit-tracking tool. It is not a medical device, and it does not provide medical advice.
The hydration targets WaterPenguin calculates are general estimates produced from the information you enter and, if enabled, weather and activity data. They are not a clinical assessment, they are not personalised medical guidance, and they have not been reviewed or approved by any medical regulator.
Your hydration needs may differ substantially from what WaterPenguin suggests. This is particularly true if you:
Drinking too much water can be dangerous. Excessive water intake can cause hyponatremia — dangerously low blood sodium — which can be serious and, in rare cases, fatal. Do not force yourself to meet a target that feels wrong for your body.
Always follow the advice of a qualified healthcare professional over anything WaterPenguin shows you. If a doctor has given you a fluid target, use that target and ignore ours. You can set your own goal manually in the app at any time.
If you feel unwell, do not rely on WaterPenguin. Seek medical attention.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.
You must be at least 13 years old to use WaterPenguin. If you are in the European Economic Area or the United Kingdom, you must be at least 16 years old.
If you are under the age of majority where you live, you may only use WaterPenguin with the consent and supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
By using the app, you confirm that you meet these requirements.
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use WaterPenguin on devices you own or control, for your own personal, non-commercial use, in accordance with these Terms and the rules of the app store you downloaded it from.
You may not:
WaterPenguin does not require you to create an account. You can use the app with your data stored locally on your device.
If you choose to enable cloud backup, you are responsible for keeping your access credentials secure and for all activity that occurs under your account.
You retain ownership of the hydration data you enter. We claim no ownership over it.
You can delete your data at any time via Settings → Delete Account, which permanently removes your hydration history, streaks, achievements, and personal data. This action cannot be undone.
WaterPenguin offers core hydration tracking features. Certain features require a paid subscription. The specific features included in each tier are shown in the app before you purchase.
If we offer you a free trial, the terms will be stated clearly on the purchase screen before you commit to anything. Our standard trial works as follows:
You can cancel at any point during the trial and you will not be charged.
Free trials are generally limited to one per user per platform. Apple and Google determine trial eligibility, not us.
Prices are shown in your local currency on the purchase screen. Subscriptions renew automatically at the end of each billing period — monthly or annually, depending on the plan you choose — unless you cancel at least 24 hours before the current period ends.
Your account is charged for renewal within 24 hours prior to the end of the current period.

You can also reach these screens from inside WaterPenguin via Settings → Subscription.
Deleting the app does not cancel your subscription. You must cancel through Apple or Google.
Purchases are processed by Apple or Google, and refunds are handled under their policies, not ours. We cannot issue refunds directly.
If you believe you were charged unfairly, contact us at support@waterpenguin.com. We will do what we can to help you with the platform and, where we have discretion, we will use it in your favour.
Where you have a statutory right of withdrawal for example, the 14-day right under EU consumer law that right applies regardless of anything in this section.
WaterPenguin integrates with services we do not control:
Your use of these services is governed by their own terms and privacy policies. We are not responsible for their availability, accuracy, or conduct. If one of them changes or stops working, features of WaterPenguin that depend on it may change or stop working too.
WaterPenguin, including its name, logo, the penguin character, its design, interface, code, text, and graphics, is owned by Codexia Technologies and protected by copyright, trademark, and other laws.
These Terms do not grant you any right to use our trademarks, logos, or branding without our prior written permission.
We aim to keep WaterPenguin available and working, but we do not guarantee uninterrupted service. The app may be unavailable during maintenance, updates, or because of factors outside our control.
We may add, change, or remove features. If we remove a feature that was a significant part of a paid subscription, we will notify you and, where appropriate, offer a pro-rata refund or an equivalent alternative.
We may discontinue WaterPenguin entirely. If we do, we will give existing subscribers reasonable notice, stop charging them, and provide a way to export their data.
To the fullest extent permitted by law, WaterPenguin is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the app will be error-free, that defects will be corrected, that it will meet your requirements, or that calculations, reminders, or syncing will always be accurate or timely.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Where you are a consumer, you have statutory rights that these Terms do not affect.
To the fullest extent permitted by law, Codexia Technologies and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of WaterPenguin.
Our total aggregate liability arising out of or relating to these Terms or the app is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD 50.
These limits do not apply to:
You agree to indemnify and hold harmless Codexia Technologies from claims, damages, and reasonable legal costs arising from your breach of these Terms or your misuse of the app. This does not apply to the extent the claim arises from our own breach, negligence, or wrongdoing.
You may stop using WaterPenguin at any time by deleting the app and, if applicable, cancelling your subscription and deleting your account.
We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the app. Where it is reasonable and lawful to do so, we will give you notice first and an opportunity to put things right.
If we terminate your access because we discontinue the app or for reasons unrelated to your conduct, we will refund any unused portion of a prepaid subscription where we are able to do so.
Sections 2, 8, 10, 11, 12, 14, and 15 survive termination.
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to conflict of law principles. The courts of Lahore, Pakistan have exclusive jurisdiction over any dispute arising from these Terms.
If you are a consumer, this does not deprive you of the protection of mandatory consumer-protection rules of the country where you habitually reside, and you may be entitled to bring proceedings in your local courts.
EU residents may use applicable consumer dispute-resolution mechanisms. The European Commission’s former Online Dispute Resolution platform at ec.europa.eu/consumers/odr has been discontinued; consult the European Commission’s current consumer dispute-resolution information for available options.
Before starting formal proceedings, we ask that you contact us at support@waterpenguin.com so we can try to resolve the matter directly. Most issues can be sorted out this way.
This section applies if you downloaded WaterPenguin from the Apple App Store.
These Terms and the Privacy Policy form the entire agreement between you and us regarding WaterPenguin.
If any provision is found unenforceable, the rest remains in effect.
If we do not enforce a provision, that is not a waiver of our right to do so later.
You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
We may update these Terms. If a change materially affects your rights, we will notify you inside the app before it takes effect and, where required, seek your agreement.
Continued use after a change takes effect means you accept the updated Terms, to the extent permitted by applicable law. If you do not accept them, stop using the app and cancel any subscription.
